Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026

Prescription is personal and for it the simple passage of the time indicated by the law shall suffice.

The periods for prescription shall be doubled with respect to those who are outside the national territory, if by this circumstance it is not possible to carry out an investigation, conclude a proceeding or execute a sanction.

Prescription shall produce its effect even if the person charged, accused and sentenced does not allege it as an exception. The jurisdictional body shall apply it ex officio in every case, as soon as it becomes aware of it, whatever the state of the proceeding.
