Narcotic drugs, psychotropic substances and other substances or plants determined by the General Health Law (Ley General de Salud), the international conventions and treaties of obligatory observance in Mexico and those indicated by the other applicable legal provisions on the matter are considered narcotics.
For the purposes of this chapter, the conducts related to the narcotic drugs, psychotropic substances and other substances provided in articles 237, 245, sections I, II, and III and 248 of the General Health Law, which constitute a serious problem for public health, are punishable.
The judge, when individualizing the penalty or the security measure to be imposed for the commission of any crime provided in this chapter, shall take into account, in addition to what is established in articles 51 and 52, the quantity and the species of narcotic in question, as well as the lesser or greater injury or endangerment of public health and the personal conditions of the perpetrator or participant of the act, or the recidivism, as applicable.
The narcotics employed in the commission of the crimes to which this chapter refers shall be placed at the disposal of the federal health authority, which shall proceed in accordance with the provisions or laws on the matter to their lawful use or their destruction.
In the case of instruments and vehicles used to commit the crimes considered in this chapter, as well as of objects and products of those crimes, whatever the nature of said goods, what is provided in articles 40 and 41 shall be observed. For that purpose, the Public Prosecutor's Office (Ministerio Público) shall order during the preliminary investigation the corresponding seizure and the appropriate destination in support of the prosecution of justice, or shall request it in the process, and shall promote the forfeiture so that the goods in question or their product are destined to the administration of justice, or, where applicable, shall promote the suspension and the deprivation of agrarian or other rights, before the authorities that result competent in accordance with the applicable rules.
