Article 209 Ter Federal Criminal Code

For the purpose of determining the damage caused to the free development of the personality of the victim, the necessary expert opinions shall be requested to know their affectation. In case of non-compliance with this provision on the part of the Public Prosecutor's Office (Ministerio Público), it shall be sanctioned in the terms of this Code and of the applicable legislation.

In the cases in which the sentenced person refuses or cannot guarantee the medical, psychological or specialty care required, the State shall provide those services to the victim.
