BOOK ONE · TITLE TWO · CHAPTER II. Imprisonment
Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026
Imprisonment consists of the penalty depriving of personal liberty. Its duration shall be from three days to sixty years, and an additional penalty to the maximum limit may only be imposed when a new crime is committed while in custody. It shall be served in the penitentiary centers, in accordance with the legislation on the matter and adjusting itself to the respective judicial resolution.
The precautionary measure of preventive imprisonment shall be counted toward the serving of the penalty imposed as well as of those that could be imposed in other causes, even if they have had as their object facts prior to admission to prison. In this case, the penalties shall be served simultaneously.
The maximum limit of the duration of the penalty depriving of liberty of up to 60 years contemplated in the present article is not applicable for the crimes that are sanctioned in accordance with what is stipulated in other laws.
