If the homicide is committed in a brawl, there shall be applied to its perpetrator from four to twelve years of imprisonment.
If the homicide is committed in a duel, there shall be applied to its perpetrator from two to eight years of imprisonment.
In addition to the provisions of articles 51 and 52 for the fixing of the penalties within the minimums and maximums indicated above, account shall be taken of who was the provoked party and who was the provoker, as well as the greater or lesser importance of the provocation.
