Article 54 Federal Criminal Code

The increase or the decrease of the penalty, founded on the qualities, on the personal relations or on the subjective circumstances of the perpetrator of a crime, are not applicable to the other subjects who intervened in the latter.

Those that are founded on objective circumstances are applicable, if the other subjects have knowledge of them.
