Article 86 Federal Criminal Code
BOOK ONE · TITLE FOUR · CHAPTER III. Preparatory liberty and retention
Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026
The competent authority shall revoke the preparatory liberty when:
I.The released person unjustifiably fails to comply with the conditions imposed to grant him the benefit. The authority may, in the case of a first non-compliance, admonish the sentenced person and warn him of revoking the benefit in the case of a second non-compliance. When the released person infringes measures that establish frequent appearances for treatment, the revocation shall only proceed upon the third non-compliance, or
II.The released person is convicted for a new intentional offense, by means of a final judgment, in which case the revocation shall operate ex officio. If the new offense is negligent, the authority may, with reasoning and according to the seriousness of the act, revoke or maintain the preparatory liberty.
The convicted person whose preparatory liberty is revoked must comply with the rest of the penalty in prison, for which the authority shall consider the time of compliance in liberty. The facts that give origin to the new proceedings to which section II of this Article refers interrupt the periods for extinguishing the sanction.
