BOOK ONE · TITLE FIVE. Of the Grounds for Extinction of the Criminal Action · CHAPTER III. Pardon of the Offended Party or of the Person Legitimated to Grant It

Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026

The pardon of the offended person or of the person legitimized to grant it may only be granted when the totality of the damages and losses occasioned by the commission of the offense have been repaired, it extinguishes the criminal action with respect to the offenses that are prosecuted by complaint, provided that it is granted before the Public Prosecutor's Office (Ministerio Público) if the latter has not exercised it or before the jurisdictional body before a second instance judgment is issued. Once the pardon is granted, it may not be revoked.

What is provided in the preceding paragraph is equally applicable to the offenses that can only be prosecuted by declaration of prejudice or by some other act equivalent to the complaint, the manifestation of whoever is authorized for that purpose that the affected interest has been satisfied being sufficient for the extinction of the criminal action.

When there are several offended persons and each one may separately exercise the faculty of pardoning the person responsible for the offense and the accessory after the fact, the pardon shall only produce effects as regards whoever grants it.

The pardon only benefits the person charged in whose favor it is granted, unless the offended person or the person legitimized to grant it, has obtained the satisfaction of his interests or rights, in which case it shall benefit all the persons charged and the accessory after the fact.
