Article 245 Bis Federal Labor Law
TITLE SIX. Special Jobs · CHAPTER IV. Work of aeronautical crews
Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The existence of a collective employment contract that covers the totality of employees shall not be an impediment for another union pact celebrated with a craft union of pilots or flight attendants to coexist with it, if the majority of the employees of the same profession express their vote in favor of the craft union.
The craft union that enrolls pilots or flight attendants may demand the entitlement to a contract that covers the totality of employees, as regards the craft that it represents. The loss of the majority declared by the Courts, after consulting the employees of the craft in dispute by personal, free, direct and secret vote, produces the loss of the entitlement to the collective employment contract.
