Article 33 Federal Labor Law
TITLE TWO. Individual Employment Relationships · CHAPTER I. General provisions
Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The waiver that employees make of accrued wages, of compensation (indemnity) and other benefits deriving from the services provided is null, whatever the form or designation given to it.
Every agreement or settlement, in order to be valid, must be made in writing and contain a detailed account of the facts that motivate it and of the rights included in it. It shall be ratified before the Conciliation Centers (Centros de Conciliación) or the Court, as applicable, which shall approve it provided that it does not contain a waiver of the rights of the employees.
When the agreement is entered into without the intervention of the authorities, the nullity thereof may be claimed before the Court, only as to that which contains a waiver of the rights of the employees, the rest of the agreed clauses remaining valid.
