TITLE SEVEN. Collective Employment Relationships · CHAPTER II. Labor unions, federations and confederations
Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The members of the labor unions, federations and confederations have the rights of free affiliation and of participation within them, which imply the following guarantees:
I.No one may be obliged to form or not to form part of a labor union, federation or confederation. Any stipulation that in any way distorts this provision shall be deemed not to have been made;
II.The procedures for the election of their boards must safeguard the full exercise of the personal, free, direct and secret vote of the members, as well as adjust to democratic rules and rules of gender equality, in terms of article 371 of this Law. The period of duration of the boards may not be indefinite or of a temporality such that it obstructs the democratic participation of the affiliates, and neither may it be harmful to the right to vote and to be voted for;
III.The sanctions that the labor unions, federations and confederations impose on their members must adhere to that established in the Law and in the statutes; for such purpose the rights of hearing and due process of the person involved must be complied with, and
IV.The board of the labor unions, federations and confederations must render them a complete and detailed account of the administration of their patrimony, in terms of article 373 of this Law.
Any stipulation that establishes a conventional fine in case of separation from the labor union or that in any way distorts the provision contained in the preceding paragraph shall be deemed not to have been made.
