Article 539 Federal Labor Law

In accordance with the provisions of the preceding article and for the purposes of article 537, the following activities correspond to the Ministry of Labor and Social Welfare:

I.In matters of promotion of employment:

a)To conduct studies to determine the causes of unemployment and of underemployment of rural and urban labor;

b)To permanently analyze the labor market, through the generation and processing of information that follows up the dynamics of employment, unemployment and underemployment in the country;

c)To formulate and permanently update the National System of Occupations, in coordination with the Ministry of Public Education and other competent authorities;

d)To promote the articulation among the actors of the labor market to improve employment opportunities;

e)To prepare reports and formulate programs to boost occupation in the country, as well as to seek their execution;

f)To orient professional training toward the areas with the greatest demand for labor;

g)To propose the entering into of agreements in matters of employment, between the Federation and the States (federal entities); and,

h)In general, to carry out all those that the Laws and regulations entrust to the Ministry of Labor and Social Welfare in this matter.

II.In matters of placement of employees:

a)To orient the job seekers toward the vacancies offered by the employers based on their training and aptitudes;

b)To authorize and register, as the case may be, the operation of private agencies dedicated to the placement of persons;

c)To oversee that the private entities referred to in the preceding subparagraph comply with the obligations imposed on them by this law, its regulations and the administrative provisions of the labor authorities;

d)To intervene, in coordination with the Ministries of the Interior (Secretaría de Gobernación), Economy (Secretaría de Economía) and Foreign Affairs (Secretaría de Relaciones Exteriores), within the scope of their respective competences, in the hiring of nationals who will provide their services abroad;

e)To propose the entering into of agreements in matters of placement of employees, between the Federation and the States (federal entities); and,

f)In general, to carry out all those that the Laws and regulations entrust to the Ministry of Labor and Social Welfare in this matter.

III.In matters of training or instruction of employees:

a)(Repealed).

b)To issue Calls for the formation of National Committees of Training, Instruction and Productivity in the industrial branches or activities in which it deems it convenient, as well as to set the bases related to the integration and the functioning of said committees;

c)To study and, as the case may be, suggest, in relation to each industrial branch or activity, the issuance of suitable general criteria for the plans and programs of training and instruction, hearing the opinion of the corresponding National Committee of Training, Instruction and Productivity;

d)To authorize and register, in the terms of article 153-C, the institutions, schools or specialized organizations, as well as the independent instructors that wish to impart training, training or instruction to the employees; to supervise their correct performance; and, as the case may be, revoke the authorization and cancel the registration granted;

e)(Repealed).

f)To study and suggest the establishment of general systems that allow training or instructing the employees, in accordance with the procedure of conventional adhesion referred to in article 153-B;

g)To render an opinion on the sanctions that must be imposed for infractions of the standards contained in Chapter III Bis of Title Four;

h)To establish coordination with the Ministry of Public Education to suggest, promote and organize plans or programs on training and instruction for work and, as the case may be, for the issuance of certificates, in accordance with the provisions of this Law, in the educational regulations and other provisions in force; and

i)In general, to carry out all those that the laws and regulations entrust to the Ministry of Labor and Social Welfare in this matter.

lV. In matters of registration of certificates of labor skills:

a)To establish registers of certificates relating to trained or instructed employees, within each one of the industrial branches or activities; and

b)In general, to carry out all those that the laws and regulations confer on the Ministry of Labor and Social Welfare in this matter.

V.In matters of linking labor and professional training with the strategic demand of the productive sector, to propose and implement mechanisms to link professional training with those priority areas for regional and national development, as well as with those that present higher indexes of demand.

VI.In matters of standardization and certification of labor competence, jointly with the Ministry of Public Education and other competent federal authorities:

a)To determine the general guidelines applicable throughout the Republic for the definition of those knowledge, skills or abilities eligible for certification, as well as of the corresponding evaluation procedures. For the setting of said guidelines, procedures shall be established that allow considering the needs, proposals and opinions of the various productive sectors; and

b)To establish a regime of certification, applicable throughout the Republic, according to which it is possible to accredit knowledge, skills or abilities, intermediate or terminal, in a partial and cumulative manner, that an individual requires for the execution of a productive activity, independently of the form in which they have been acquired.
