Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

In the review of the minimum wages referred to in the second paragraph of Article 570 of the Law, the following procedures shall be observed:

I.The President of the National Commission, within the three days following the date on which he has received the request of the Secretary of Labor and Social Welfare, or, as the case may be, the one submitted to him by the organizations of employees or the employers, shall call the Council of Representatives to study the request and decide whether the grounds supporting it are sufficient to initiate the review process. If the resolution is in the affirmative, he shall order the Technical Office to prepare a report that considers the movement of prices and their repercussions on the purchasing power of the minimum wages, as well as the most significant data of the national economic situation, so that the Council of Representatives may have the necessary information to review the minimum wages in force and set, as the case may be, those that must be established. If his resolution is negative, he shall bring it to the knowledge of the Secretary of Labor and Social Welfare;

II.The Technical Office shall have a period of five days, counted from the date on which it has been instructed by the President of the National Commission, to prepare the report referred to in the preceding section and send it to the Council of Representatives through the President of the Commission;

III.The Council of Representatives, within the three days following the date on which it receives the report of the Technical Office, shall issue the corresponding resolution setting, as the case may be, the minimum wages that must be established;

IV.The resolution of the National Commission shall establish the date on which the validity of the new minimum wages that are set must begin, which may not be later than ten days counted from the date on which the resolution is issued; and

V.The President of the National Minimum Wage Commission shall order the publication of the Resolution in the Official Gazette of the Federation within the three days following the date on which it has been issued
