Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

With the reply brief and its annexes, the Court shall serve the defendant party, granting it a term of five days to formulate its counter-reply in writing and, if applicable, to object to the evidence that has been offered with it. The defendant, when presenting its counter-reply, must attach a copy for service on the plaintiff party. In the event that the defendant party offers evidence in relation to its counter-reply in accordance with the provisions of article 873-A of this Law, it must also attach a copy thereof, so that service be made on the plaintiff party, and the latter states within the term of three days what corresponds to its interest.

If the reply or counter-reply is not formulated within the granted term, the right shall be deemed lost as the case may be and the proceeding shall continue.

Once the terms indicated in the last two preceding paragraphs have elapsed, the Court shall set a date to hold the preliminary hearing, which shall take place within the following ten days.
