Current text · last reform published in the Official Gazette of the Federation (DOF) on 2 June 2026
In order to proceed criminally against the deputies and senators of the Congress of the Union, the ministers of the Supreme Court of Justice of the Nation, the magistrates of the Electoral Tribunal (Tribunal Electoral), the Magistrates of the Judicial Discipline Tribunal (Tribunal de Disciplina Judicial), the members of the Plenary of the judicial administration organ, the Secretaries of State, the Attorney General of the Republic, as well as the counselor President and the electoral counselors of the General Council of the National Electoral Institute (Instituto Nacional Electoral), for the commission of crimes during the time of their term, the Chamber of Deputies shall declare by absolute majority of its members present in session, whether or not there is ground to proceed against the accused person.
If the resolution of the Chamber is negative, all further proceeding shall be suspended, but this shall not be an obstacle for the imputation for the commission of the crime to continue its course when the accused has concluded the exercise of his or her term, since the same does not prejudge the grounds of the imputation.
If the Chamber declares that there is ground to proceed, the subject shall be placed at the disposal of the competent authorities so that they act in accordance with the law.
In order to proceed criminally against the President of the Republic, there shall only be ground to accuse him before the Senate in the terms of article 110. In this case, the Senate shall resolve based on the applicable criminal legislation.
In order to proceed criminally for federal crimes against the persons holding the executive powers of the states (federal entities), local deputies, magistrates of the Superior Courts of Justice of the states (federal entities), as the case may be, members of the Judicial Discipline Tribunals and local judicial administration organs, and the members of the organisms to which the Local Constitutions grant autonomy, the same procedure established in this article shall be followed, but in this case, the declaration of proceeding shall be for the effect that the Local Legislatures be notified, so that in exercise of their attributions they proceed as corresponds.
The declarations and resolutions of the (sic DOF 28-12-1982) Chambers of Deputies (sic DOF 28-12-1982) Senators are unchallengeable.
The effect of the declaration that there is ground to proceed against the accused shall be to separate him or her from his or her office as long as he or she is subject to criminal proceeding. If this culminates in a judgment (sentencia) of acquittal, the accused may reassume his or her function. If the judgment is one of conviction and it deals with a crime committed during the exercise of his or her office, the pardon shall not be granted to the convicted person.
In civil actions brought against any public official, no declaration of proceeding shall be required.
The criminal sanctions shall be applied in accordance with the provisions of the criminal legislation, and in the case of crimes for whose commission the perpetrator obtains an economic benefit or causes patrimonial damages or injuries, they shall be graduated in accordance with the profit obtained and with the need to satisfy the damages and injuries caused by his or her unlawful conduct.
The economic sanctions may not exceed three times the benefits obtained or the damages or injuries caused.
