Current text · last reform published in the Official Gazette of the Federation (DOF) on 2 June 2026
The Powers of the Union have the duty to protect the states against every invasion or external violence. In each case of insurrection or internal disturbance, they shall provide them equal protection, provided that they are requested by the Legislature of the state or by its Executive, if the former is not in session.
The states are obliged to surrender without delay the accused or sentenced persons, as well as to carry out the securing and delivery of objects, instruments or products of the crime, at the request of the authority of any other state that requires them. These proceedings shall be carried out, with the intervention of the respective prosecution authorities, in the terms of the collaboration agreements that, for that purpose, the states enter into. For the same purposes, the local authorities may enter into collaboration agreements with the Office of the Attorney General of the Republic.
Extraditions at the request of a foreigner State shall be processed by the Federal Executive, with the intervention of the judicial authority in the terms of this Constitution, the international treaties that are signed in that regard and the regulatory laws. In those cases, the order of the judge that orders compliance with the request shall be sufficient to justify detention for up to sixty calendar days.
