First Title · Chapter I. On Human Rights and Their Guarantees

Current text · last reform published in the Official Gazette of the Federation (DOF) on 2 June 2026

No person may be impeded from dedicating themselves to the profession, industry, commerce or work that suits them, provided they are lawful. The exercise of this freedom may only be prohibited by judicial determination, when the rights of a third party are attacked, or by governmental resolution, issued in the terms that the law sets, when the rights of society are offended. No one may be deprived of the product of their work, except by judicial resolution.

The profession, industry, internal or external commerce, work or any other of the activities referred to in the fifth paragraph of article 4o. above is prohibited.

The law shall determine in each state (federal entity), which are the professions that need a title for their exercise, the conditions that must be fulfilled in order to obtain it and the authorities that are to issue it.

No one may be obliged to provide personal work without fair remuneration and without their full consent, except work imposed as a penalty by the judicial authority, which shall be adjusted to the provisions of sections I and II of article 123.

As regards public services, only that of arms and juries may be obligatory, in the terms that the respective laws establish, as well as the performance of municipal offices and those of popular election, direct or indirect. Electoral and census functions shall have an obligatory and unpaid character, but those that are performed professionally shall be remunerated in the terms of this Constitution and the corresponding laws. Professional services of a social nature shall be obligatory and remunerated in the terms of the law and with the exceptions that it indicates.

The State cannot permit that any contract, pact or agreement be carried into effect that has as its object the impairment, the loss or the irrevocable sacrifice of the freedom of the person for any cause.

Nor may an agreement be admitted in which the person agrees to their proscription or banishment, or in which they renounce temporarily or permanently the exercise of a determined profession, industry or commerce.

The employment contract shall only oblige the provision of the service agreed for the time that the law fixes, without being able to exceed one year to the detriment of the employee, and may not be extended, in any case, to the renunciation, loss or impairment of any of the political or civil rights.

The non-fulfillment of said contract, as regards the employee, shall only oblige the latter to the corresponding civil responsibility, without in any case coercion being able to be exercised over their person.
