Article 110 Federal Criminal Code

BOOK ONE · TITLE FIVE. Of the Grounds for Extinction of the Criminal Action · CHAPTER VI. Prescription

Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026

The prescription of the actions shall be interrupted by the proceedings that are carried out in the investigation and those of the persons charged, even if, because it is unknown who they are, the proceedings are not carried out against a specific person.

If no proceedings are carried out, the prescription shall begin to run again from the day following that of the last procedural act.

The prescription of the actions shall also be interrupted by the request for assistance in the investigation of the offense or of whoever has committed it or participated in its commission, by the proceedings that are carried out to obtain international extradition, and by the request for delivery of the person charged that the Public Prosecutor's Office of a federal entity formally makes to that of another where the former takes refuge, is located or is detained for the same or another offense. In the first case, the proceedings that the requested authority carries out shall also cause the interruption, and in the second, the interruption shall subsist until the requested authority denies the delivery or until the legal situation of the detainee disappears, which gives rise to the postponement of his delivery.

The interruption of the prescription of the criminal action may only extend by up to one half the periods indicated in Articles 105, 106 and 107 of this Code.
