Article 266 Federal Criminal Code

It is equated to rape and shall be sanctioned with from eight to thirty years of imprisonment:

I.On anyone who without violence carries out copulation with a person minor of eighteen years of age;

II.- On anyone who without violence carries out copulation with a person who does not have the capacity to comprehend the meaning of the act or for any cause cannot resist it; and

III.On anyone who without violence and with lewd purposes introduces by anal or vaginal route any element or instrument different from the virile member in a person minor of eighteen years of age or a person who does not have the capacity to comprehend the meaning of the act, or for any cause cannot resist it, whatever the sex of the victim.

If physical or moral violence is exerted, the minimum and the maximum of the penalty shall be increased by up to one half.
