For the application of the penalty, the robbery shall be considered consummated from the moment in which the thief has the stolen thing in his power; even when he abandons it or they dispossess him of it. As for the fixing of the value of the stolen property, as well as the fine imposed, the wage at the moment of the execution of the crime shall be taken into consideration.
