In the case of an ideal concurrence, the sanctions corresponding to the offense that merits the greatest penalty shall be imposed, which may be increased without exceeding one half of the maximum of the duration of the corresponding penalties of the remaining offenses, provided that the applicable sanctions are of the same nature; when they are of a different nature, the legal consequences indicated for the remaining offenses may be imposed, with the exception of the cases in which one of the offenses for which an ideal concurrence exists is one of those contemplated in the General Law to Prevent and Punish Offenses on the Matter of Kidnapping, and the General Law to Prevent, Punish and Eradicate Offenses on the Matter of Trafficking in Persons and for the Protection and Assistance of the Victims of these Offenses, both regulatory of section XXI of Article 73 of the Political Constitution of the United Mexican States, cases in which the rules of real concurrence shall be applied.

In the case of a real concurrence, the sanction of the most serious offense shall be imposed, which may be increased with the penalties that the law contemplates for each one of the remaining offenses, without exceeding the maximums indicated in Title Second of Book First. In the case of a continuing offense, the criminal sanction shall be increased by up to one half of that corresponding to the maximum of the offense committed, without exceeding the maximum indicated in Title Second of Book First.
