In the event that the error referred to in subparagraph a) of section VIII of Article 15 is avoidable, the punishability of the negligent offense shall be imposed if the act in question admits said form of realization. If the avoidable error is the one provided for in subparagraph b) of said section, the penalty shall be of up to one third of the offense in question.
