Persons lacking criminal responsibility may be delivered by the judicial or enforcement authority, as applicable, to those who legally correspond to take charge of them, provided that they undertake to take the adequate measures for their treatment and vigilance, guaranteeing, by any means and to the satisfaction of the mentioned authorities, compliance with the obligations assumed.
The enforcement authority may resolve on the modification or conclusion of the measure, in a provisional or definitive form, considering the needs of the treatment, which shall be evidenced by means of periodic reviews, with the frequency and characteristics of the case.
