Article 7 Federal Criminal Code

BOOK ONE · TITLE ONE. Criminal Responsibility · CHAPTER I. General rules on crimes and responsibility

Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026

Crime is the act or omission that the criminal laws sanction.

In crimes of material result, the typical result produced shall also be attributable to the person who omits to prevent it, if the latter had the legal duty to avoid it. In these cases, the result shall be considered a consequence of an omissive conduct, when it is determined that the person who omits to prevent it had the duty to act for that purpose, derived from a law, from a contract or from his own preceding conduct.

The crime is:

I.Instantaneous, when the consummation is exhausted at the same moment in which all the elements of the criminal description have been realized;

II.- Permanent or continuous, when the consummation is prolonged in time, and

III.- Continued, when with unity of criminal purpose, plurality of conducts and unity of passive subject, the same legal precept is violated.
