Article 71 Federal Criminal Code
BOOK ONE · TITLE THREE. Application of Sanctions · CHAPTER VI. Substitution and commutation of sanctions
Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026
The judge shall leave the substitution without effect and shall order that the prison penalty imposed be executed, when the sentenced person does not comply with the conditions that were indicated to him for such purpose, except that the adjudicator deems it convenient to warn him that if a new fault is incurred, the substituted sanction shall be made effective, or when the sentenced person is convicted for another offense. If the new offense is negligent, the judge shall resolve whether the substituted penalty must be applied.
In the event of the substituted prison penalty being made effective, the time during which the sentenced person has complied with the substitute sanction shall be taken into account.
