Article 72 Federal Criminal Code
BOOK ONE · TITLE THREE. Application of Sanctions · CHAPTER VI. Substitution and commutation of sanctions
Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026
In the event of a bondsman having been appointed for the compliance with the duties inherent to the substitution of sanctions, the obligation of the former shall conclude upon the extinction of the penalty imposed. When the bondsman has well-founded motives not to continue in his performance, he shall state them to the judge, so that the latter, if he deems them just, may order the sentenced person to present a new bondsman within the period that he must prudently set for him, warned that the sanction shall be made effective if he does not do so. In the event of death or insolvency of the bondsman, the sentenced person must bring the fact to the knowledge of the judge, for the purpose and under the warning expressed in the preceding paragraph, in the terms of section VI of Article 90.
