TITLE FOUR. Rights and Obligations of Employees and Employers · CHAPTER III. Housing for employees

Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

The credits granted by the entity that administers the National Housing Fund shall be covered by insurance, for the cases of total permanent disability or death, which releases the employee or their beneficiaries from the obligations, liens or limitations on ownership in favor of the said entity, derived from those credits.

For such purposes, total permanent disability shall be understood as the loss of faculties or aptitudes of a person that renders them unable to perform any work for the rest of their life, whatever the nature of the risk that produced it.

In the case of partial permanent disability, when it is 50% or more, or definitive invalidity, the credited employee shall be released from the debt, the liens or limitations on ownership in favor of the Institute, provided that they do not enter into a new employment relationship for a minimum period of two years, a period during which they shall enjoy an extension for the payment of their credit, without interest accruing. The existence of any of these circumstances must be proven before the National Workers' Housing Fund Institute within the month following the date on which they are determined.

In the cases in which the disabled employee who, during the period indicated in the preceding paragraph, has entered into a new employment relationship and loses it, may restart the procedure for the cancellation of their credit before the Institute as many times as necessary, provided that the determination of their disability is not revoked in the terms of the Social Security Law.
