The termination of the employment relationships of the employees shall be subject to the following rules:

I.When ten days or less remain before their expiration and a new trip is intended that exceeds this term in duration, the employees may request the termination of the employment relationships, giving notice three days in advance of the departure of the vessel;

II.The employment relationships cannot be given as terminated when the vessel is at sea or when, being in port, the termination is attempted within the twenty-four hours prior to its departure, unless in this latter case the final destination of the vessel is changed;

III.Neither can the employment relationships be given as terminated when the vessel is abroad, in unpopulated places or in port, provided that in this latter case the vessel is exposed to any risk from bad weather or other circumstances;

IV.When the employment relationships are for an indefinite time, the employee shall give notice to the shipowner, shipping company or charterer with seventy-two hours of anticipation;

V.When the vessel is lost by capture or disaster, the employment relationships shall be given as terminated, the shipowner, shipping company or charterer being obligated to repatriate the employees and to cover the amount of the wages until their restitution to the port of destination or to the one that has been designated in the contract, and that of the other benefits to which they are entitled. The employees and the employer may agree that work of the same category be provided to them on another vessel of the employer; if no agreement is reached, the employees shall have the right to be compensated in accordance with the provisions of article 436; and

VI.The change of nationality of a Mexican vessel is a cause of termination of the employment relationships. The shipowner, shipping company or charterer is obligated to repatriate the employees and to cover the amount of the wages and benefits to which the first paragraph of the preceding section refers. The employees and the employer may agree that work of the same category be provided to them on another vessel of the employer; if no agreement is reached, the employees shall have the right to be compensated in accordance with the provisions of article 50.
