Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The Court, at the request of a party, shall deem the action brought withdrawn as to any person who does not make any application within the term of four months, provided that such application is necessary for the continuation of the procedure and the provisions of the preceding article have been complied with. Said term shall not be considered to operate if the plaintiff's evidence has been produced or a resolution on any application of the parties referred to in this article is pending, or the carrying out of any proceeding, or the return of a letter rogatory or the receipt of reports or copies that have been requested from another authority within the procedure is pending agreement.
For the effects of the preceding paragraph, the Court shall summon the parties to a hearing, at which, after hearing them and receiving the evidence they offer, which must refer exclusively to the admissibility or inadmissibility of the withdrawal, it shall issue a resolution.
