The instructor secretary of the Court, at the request of a party, may decree the following precautionary measures:
I.Prohibition from leaving the national territory or a determined locality when there is fear that the person against whom a claim is filed or has been filed will absent themselves or hide;
II.Precautionary attachment, when it is necessary to secure the assets of a person, company or establishment.
III.Require the employer to refrain from removing the pregnant employee who has been dismissed from the social security institution in which she is affiliated, when in the Court's judgment there are sufficient indications to presume that she was separated by reason of her condition; said measure shall be applied provided that a medical certificate accrediting the pregnancy, issued in accordance with the requirements and formalities contemplated in the law, is attached to the complaint, and
IV.In the cases in which discrimination in employment is claimed, such as discrimination by pregnancy, or sexual orientation, or by gender identity, as well as in the cases of child labor, the court shall take the necessary measures to avoid that the enjoyment of fundamental rights, such as social security, is cancelled, while the labor trial is resolved, or shall decree the security measures for the persons who so warrant it. For this purpose, the plaintiffs must accredit the existence of indications that generate in the Court the reasonable suspicion, appearance or presumption of the acts of discrimination that they assert.
