TITLE FOURTEEN. Labor Procedural Law · CHAPTER XV. On Precautionary Measures

Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

The precautionary measures indicated in sections I and II of the preceding article may be requested upon presenting the complaint, or later whether they are formulated in writing or in an appearance. In the first case, they shall be processed prior to the service of process and in the second, by separate file. In neither of the two cases shall the request be brought to the knowledge of the person against whom the measure is requested.

The precautionary measures provided in sections III and IV of article 857 of this Law must be requested upon presenting the complaint.

The precautionary measures may be challenged through the reconsideration appeal; this shall be filed in writing within the three days following those in which knowledge is had of the act being challenged, in which the grievances caused by the challenged measure shall be expressed; giving notice to the opposing party for the term of three days so that it states what is in its interest.

Once the term of the notice has elapsed, the appeal shall be resolved without further procedure by the judge of the proceedings at the preliminary hearing.

In the event that the precautionary measure is decreed after the preliminary hearing, and the reconsideration appeal is filed, once the notice to the opposing party has been exhausted, the Court shall resolve without further procedure.
