Article 873-K Federal Labor Law
TITLE FOURTEEN. Labor Procedural Law · CHAPTER XVII. On the ordinary procedure · Section Two. Trial Hearing
Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
Against the resolutions pronounced in the ordinary labor proceeding, no appeal shall lie, except the reconsideration appeal against the acts of the instructing secretary established in article 871 of this Law. Nevertheless, whether ex officio or at the request of a party, the judge may correct the omissions or errors he has incurred, or may specify some point, until before issuing judgment; likewise, he may clarify the latter once it has been issued.
In view of the nature and purposes of labor law, the judge must assume a proactive performance, in which he permanently drives the proceeding, avoiding that the formal deficiencies or inconsistencies committed during its development have an impact to the detriment of the parties, causing its delay in the future, and therefore if he notices them he may correct them. At all times conciliation shall be encouraged as the privileged route for the solution of the conflict.
