Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The complaint and answer documents shall be presented before the competent Court and must comply with the requirements referred to in articles 872 and 873-A of this Law, insofar as applicable.
The conflicts between labor unions referred to in articles 389 and 418 of this Law shall be resolved solely through the consultation of the employees, who shall manifest their will through the personal, free, direct and secret vote, and therefore it cannot be a matter of negotiation, being essential elements of democracy and of the human rights linked to it. In these cases and when dealing with violations of fundamental rights in collective matters that undermine freedom of association, union freedom or the right to collective bargaining, or when procedures for the election of the union leaderships are challenged, in order to bring the proceeding it shall not be necessary to resort to prejudicial conciliation nor to submit the corresponding certificate.
Claims unrelated to the purpose of this route may not be accumulated in it; if claimed, the rights of the parties shall be left safe so that they exercise them in the corresponding route.
