TITLE FOURTEEN. Labor Procedural Law · CHAPTER XVIII. On the Special Procedure

Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

Once the Court admits the complaint with the required documents and copies, service shall be made on the defendant, who must answer it in writing within the ten days following the date of the summons, covering the requirements indicated in article 873-A of the Law and objecting to the plaintiff's evidence, under warning that if he fails to do so the provisions of said legal precept shall apply. In conflicts over the title to collective bargaining, submission to the complaint shall not prevent the continuation of the proceeding.

With a copy of the document answering the complaint and its annexes, service shall be made on the plaintiff party so that within the term of three days it formulates a reply and objects to the evidence of its counterparty. Once this has been done, service shall be made on the defendant party so that within the same term it makes its counter-reply. Once the reply and counter-reply have been formulated or the terms therefor have elapsed, an order shall be issued setting the date for the holding of the trial hearing, which must take place within the following five days, except as provided in article 897-F of this Law.

In the same order the judge shall purify the proceeding and, if applicable, resolve the procedural exceptions that have been raised; likewise, he shall admit or reject the evidence, as the case may be. He shall also set the manner of preparation of the evidence and order the issuance of the official letters or summonses that correspond in accordance with the provisions of chapter XII of Title Fourteen of this Law.
