Article 927 Federal Labor Law
TITLE FOURTEEN. Labor Procedural Law · CHAPTER XX. Strike Procedure
Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The conciliation hearing shall conform to the following rules:
I.If the employer opposed the exception of lack of legal standing when answering the statement of demands, the Court shall previously resolve this situation and, in the case of declaring it unfounded, the hearing shall continue;
II.If the employees do not attend the conciliation hearing, the term for the suspension of the work shall not run;
III.The Court may employ the enforcement measures to oblige the employer to attend the conciliation hearing;
IV.The effects of the notice referred to in Article 920, section II of this Law shall not be suspended by the conciliation hearing nor by the default of the employer in attending it.
V.After the employer is served, at the request of the union the pre-strike period may be extended or enlarged on a single occasion for up to thirty days. In the case of companies or institutions that depend on public resources, it may be extended for a longer term. Likewise, additional extensions may be admitted when in the Court's judgment there is cause that justifies it.
In the event that the initial collective employment contract or the agreement for the review of the collective contract is not approved by the employees in terms of the provisions of Article 390 Ter, section II, the union may extend the pre-strike period for up to fifteen days. Nevertheless, when the circumstances so warrant it, the Court may authorize that the extension be extended for a maximum of thirty days, provided that the union so requests and justifies it at the time of filing the request.
Independently of the foregoing, the parties by common agreement may extend or enlarge the pre-strike period in order to reach a conciliatory agreement; nevertheless, the extension may not have a duration that affects the rights of third parties.
In the case of strike notices for the signing of a collective employment contract for specific work, the pre-strike period may not exceed the term of duration of the work.
