Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
The third-party claims shall be processed and resolved by the Court hearing the principal trial, being heard as an incidental matter, in accordance with the following rules:
I.The third-party claim shall be filed in writing, accompanied by the title on which it is founded and the pertinent evidence; if the foregoing requirements are not met, it shall be rejected outright;
II.The Court shall order that the third-party claim be processed in a separate file and shall summon the parties to a hearing, within the following ten days, at which it shall hear them and, after the evidence has been taken, shall issue a resolution;
III.As regards the offering, admission and taking of evidence, the provisions of Chapters XII, XVII and XVIII of Title Fourteen of this Law shall be observed;
IV.The third-party claims do not suspend the processing of the proceeding. The third-party claim exclusionary of ownership suspends only the act of auction; the preferential one, the payment of the credit; and
V.If the third-party claim is declared admissible, the Court shall order the lifting of the attachment and, as the case may be, shall order that the credit declared preferential be paid.
