Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
When there is an individual or collective conflict, the employees may request the Court, for the purposes of article 113, that it give notice to the judicial or administrative authority before which trials are being processed in which it is intended to enforce credits against the employer, so that, before carrying out the auction or the adjudication of the attached property, it notify them in order to guarantee the preferential right that the Law grants them in said provision, once the corresponding third-party claim exclusionary of preference has been processed and its amount has been determined.
If the attached property is insufficient to cover the credits of all the employees, they shall be distributed pro rata, without prejudice to their rights.
