First Title · Chapter I. On Human Rights and Their Guarantees
Current text · last reform published in the Official Gazette of the Federation (DOF) on 2 June 2026
In the cases of invasion, grave disturbance of the public peace, or of any other that puts society in grave danger or conflict, only the President of the United Mexican States, with the approval of the Congress of the Union or of the Permanent Commission (Comisión Permanente) when the former is not assembled, may restrict or suspend in all the country or in determined place the exercise of the rights and the guarantees that were an obstacle to confront, rapidly and easily, the situation; but he must do it for a limited time, by means of general provisions and without the restriction or suspension being limited to a determined person. If the restriction or suspension takes place while the Congress is assembled, it shall grant the authorizations that it deems necessary so that the Executive confronts the situation; but if it takes place in time of recess, the Congress shall be convened immediately so that it approves them.
In the decrees that are issued, may not be restricted nor suspended the exercise of the rights to non-discrimination, to the recognition of the juridical personality, to life, to the personal integrity, to the protection of the family, to the name, to the nationality; the rights of children; the political rights; the freedoms of thought, conscience and of professing some religious belief; the principle of legality and retroactivity; the prohibition of the death penalty; the prohibition of slavery and servitude; the prohibition of enforced disappearance and torture; nor the judicial guarantees indispensable for the protection of such rights.
The restriction or suspension of the exercise of the rights and guarantees must be founded and motivated in the terms established by this Constitution and be proportional to the danger to which it is confronted, observing at all times the principles of legality, rationality, proclamation, publicity and non-discrimination.
When the restriction or suspension of the exercise of the rights and guarantees is brought to an end, whether for the period being completed or because the Congress so decrees, all the legal and administrative measures adopted during its validity shall be without effect immediately. The Executive may not make observations to the decree by means of which the Congress revokes the restriction or suspension.
The decrees issued by the Executive during the restriction or suspension, shall be reviewed ex officio and immediately by the Supreme Court of Justice of the Nation, which must pronounce with the greatest promptness on their constitutionality and validity.
