Current text · last reform published in the Official Gazette of the Federation (DOF) on 2 June 2026
In case of absolute absence of the President of the Republic, while the Congress appoints the interim or substitute president, which must occur within a term no greater than sixty days, the Secretary of the Interior shall provisionally assume the office of the Executive Power. In this case, the provisions of sections II, III and VI of article 82 of this Constitution shall not be applicable.
Whoever provisionally occupies the Presidency may not remove or appoint the Secretaries of State without prior authorization of the Senate. Likewise, he shall deliver to the Congress of the Union a report of activities within a period no greater than ten days, counted from the moment in which his office ends.
When the absolute absence of the President occurs in the first two years of the respective period, if the Congress of the Union is in sessions and at least two thirds of the total number of the members of each Chamber are present, it shall immediately constitute itself in Electoral College and shall appoint, by secret ballot and by absolute majority of votes, an interim president, in the terms provided by the Congress Law. The same Congress shall issue, within the ten days following said appointment, the call for the election of the President who must conclude the respective period, there having to elapse between the date of the call and the date indicated for the holding of the electoral working day, a period no less than seven months nor greater than nine. The person thus elected shall begin his office and shall take the oath before the Congress seven days after the conclusion of the electoral process.
If the Congress is not in sessions, the Permanent Commission shall immediately convene it to extraordinary sessions so that it constitutes itself in Electoral College, appoints an interim president and issues the call for presidential elections in the terms of the preceding paragraph.
When the absolute absence of the President occurs in the last four years of the respective period, if the Congress of the Union is in sessions, it shall designate the substitute president who must conclude the period, following, insofar as applicable, the same procedure as in the case of the interim president.
If the Congress is not assembled, the Permanent Commission shall immediately convene it to extraordinary sessions so that it constitutes itself in Electoral College and appoints a substitute president, following, insofar as applicable, the same procedure as in the case of the interim president.
In case the mandate of the President of the Republic has been revoked, whoever occupies the presidency of the Congress shall provisionally assume the office of the Executive Power; within the following thirty days, the Congress shall appoint who shall conclude the constitutional period. In that period, insofar as applicable, the provisions of the first, second, fifth and sixth paragraphs shall apply.
