Article 199 Decies Federal Criminal Code

The minimum and the maximum of the penalty shall be increased by up to one half:

I.- When the crime is committed by the spouse, male or female cohabitant, or by any person with whom the victim has or has had a sentimental, affective or trust relationship;

II.- When the crime is committed by a public official in the exercise of their functions;

III.- When it is committed against a person who cannot understand the meaning of the act or does not have the capacity to resist it;

IV.- When any type of non-profit benefit is obtained;

V.- When it is done for profit purposes, or

VI.- When, as a consequence of the effects or impacts of the crime, the victim attempts against their integrity or against their own life.
