Article 35 Federal Criminal Code
BOOK ONE · TITLE TWO · CHAPTER V. Pecuniary sanction
Current text · last reform published in the Official Gazette of the Federation (DOF) on 13 March 2026
The amount of the pecuniary sanction shall be distributed: between the State and the offended party; the amount of the fine shall be applied to the former, and that of the reparation to the latter.
If it is not achieved to make effective the entire amount of the pecuniary sanction, the reparation of damage shall be covered by preference, and as the case may be, pro rata among the offended parties.
If the offended party waives the reparation, the amount of the latter shall be applied to the State.
In the case that a precautionary measure has been imposed to guarantee the reparation of damage, it shall be made effective in favor of the victim or offended party when the judgment (sentencia) that condemns to repair the damage becomes final.
