Article 239 Federal Labor Law

The seniority ladder of the aeronautical crews shall take into consideration:

I.The technical, physical and mental capacity of the interested party, referred to the equipment that corresponds to the position of promotion;

II.The prior experience, determined, according to the specialty, by the hours of flight registered before the competent authority or by the instructions and practice in the case of the crew members who are not obligated to register said hours of flight; and

III.Seniority, where conditions are equal.
