Article 491 Federal Labor Law
TITLE NINE. Occupational Hazards
Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
If the hazard produces a temporary disability in the employee, the compensation (indemnity) shall consist of the full payment of the wage he ceases to receive while the impossibility to work subsists. This payment shall be made from the first day of the disability.
If three months after a disability has begun the employee is not in a position to return to work, he or the employer may request, in view of the respective medical certificates, the opinions rendered and the pertinent evidence, that it be resolved whether he should continue subject to the same medical treatment and enjoy the same compensation (indemnity) or whether it proceeds to declare his permanent disability with the compensation (indemnity) to which he is entitled. These examinations may be repeated every three months. The employee shall receive his wage until his permanent disability is declared and the compensation (indemnity) to which he is entitled is determined.
