Article 498 Federal Labor Law
TITLE NINE. Occupational Hazards

The employer is obliged to reinstate in his employment the employee who suffered an occupational hazard, if he is fit, provided he presents himself within the year following the date on which his disability was determined.
The provisions of the previous paragraph are not applicable if the employee received the compensation (indemnity) for permanent total disability.
