Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026
In the production of the confessional evidence the following rules shall be observed:
I.The questions and/or interrogatories shall be formulated orally at the moment of the hearing by means of open questioning, without presentation of written sets of interrogatories; they must refer to the facts in dispute in clear and precise terms, which can be understood without difficulty, and whose purpose is to clarify the truth of the facts;
II.The judge, on his own motion or at the request of a party, may reject the questions that do not meet said requirements, justifying his decision; he may also formulate to the persons answering the interrogatories the questions he considers pertinent, as well as order them to specify or clarify their answers;
III.The declarant, under protest to tell the truth, shall answer by himself, without being assisted by any person. He may not avail himself of a draft of answers, but he shall be allowed to consult notes or memoranda, if the judge resolves that they are necessary to aid his memory;
IV.Repealed.
V.Repealed.
VI.The declarant shall answer the interrogatories or questions formulated to him, and may add the explanations he judges convenient or those the Court asks of him;
VII.If the declarant refuses to answer or his answers are evasive, the Court, on its own motion or at the request of a party, shall warn him at that moment that he shall be deemed confessed as to the facts attributed to him if he persists in that attitude.
