TITLE THREE. Working Conditions · CHAPTER V. Wage

Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

The wage may be fixed by unit of time, by unit of work, by commission, at a lump sum price or in any other manner.

In the case of wage by unit of time, that nature shall be specifically established. The employee and the employer may agree the amount, provided that it is a remunerative wage, as well as the payment for each hour of rendering of service, provided that the legal maximum working day is not exceeded and the labor and social security rights corresponding to the position in question are respected. The income that the employees receive for this modality shall in no case be less than that corresponding to a daily working day.

When the wage is fixed by unit of work, in addition to specifying the nature of the latter, there shall be stated the quantity and quality of the material, the state of the tool and implements that the employer, where applicable, provides to execute the work, and the time for which he shall place them at the disposal of the employee, without him being able to demand any amount on account of the natural wear that the tool suffers as a consequence of the work.
