Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

The complaint shall be filed in writing, attaching as many copies thereof as there are defendants. In the event that the plaintiff is the employee and copies are missing, this shall not be grounds for a requirement to cure defects, archiving, or rejection. The Court must cure that omission ex officio.

A.The complaint must be signed and state the following:

I.The court before which the complaint is filed;

II.The name and address of the plaintiff; the latter may request that the subsequent orders and resolutions, including the judgment issued in the case, be notified to him in the electronic mailbox assigned to him by the Court;

III.The name or corporate name of the defendant, as well as his address. When the employee does not know the name of the employer or the name or corporate name of the establishment in which he works or worked, he must provide the data established by article 712 of this Law; the employee may attach to his complaint any data or element he deems convenient to facilitate the location of the defendant's address, such as location sketches, photographs of the property or a map indicating its exact location;

IV.The benefits claimed;

V.The facts on which he bases his petitions;

VI.The list of evidence that the plaintiff intends to be rendered at trial, expressing the fact or facts intended to be demonstrated with them, and

VII.In the event that there is a prior trial brought by the plaintiff against the same employer, he must report it in the new complaint.

B.The following must be attached to the complaint:

I.The record issued by the Conciliation Body certifying the conclusion of the prejudicial conciliation procedure without agreement between the parties, except in the cases in which said record is not required, as expressly established by this Law;

II.The documents evidencing the legal standing of his representative in accordance with article 692, section II, if the complaint is filed through the latter, and

III.The evidence available to the plaintiff, accompanied by the elements necessary for its taking. In the event that he cannot directly provide any evidence intended to prove the facts on which he bases his complaint, he must indicate the place where it may be obtained and the proceedings whose conduct he requests for the same purpose. The offering of evidence must comply with the provisions of chapter XII of Title Fourteen of this Law.
