Within the twenty-four hours following the filing of the complaint, it must be referred to the corresponding Court; if the complaint is in accordance with law, the latter must issue the respective admission order within the three days following its referral or following its correction in the terms of the third paragraph of this article.
Upon the filing of the complaint, the Court shall assign the plaintiff an electronic mailbox, providing the corresponding user name and access password, through which he may consult his file and review the orders issued therein.
When the plaintiff is the employee or his beneficiaries, if the Court notices any irregularity in the complaint document or contradictory actions are brought or the base wage of the action has not been specified, in the order it shall point out the defects or omissions incurred and shall require him to correct them within a term of three days. Said order must be notified personally to the plaintiff.
If the plaintiff fails to correct the complaint within the granted term, the Court shall correct the omissions or irregularities based on the evidentiary material that the plaintiff attaches to his complaint and in accordance with the labor rules; once the foregoing is done, the Court shall admit the complaint.
No additional evidence shall be received other than that offered in the complaint, except that referring to facts related to the reply, provided that it deals with those of which the plaintiff had no knowledge when filing his complaint, as well as that offered to support the objections made to the evidence of the other parties, or that referring to the objection of witnesses. The foregoing without prejudice to the possibility of offering evidence on supervening facts.
The Court may only admit the expansion of the complaint in the event that in the answer to it novel facts are asserted, of which the plaintiff had no knowledge when filing his complaint.
