Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

Individual social security conflicts are those whose purpose is to claim the granting of benefits in money or in kind, derived from the various insurances that make up the mandatory regime of Social Security, organized and administered by the Mexican Social Security Institute (IMSS), and of those that, in accordance with the Social Security Law and the Law of the National Workers' Housing Fund Institute, must be covered by the National Workers' Housing Fund Institute (INFONAVIT) and the Retirement Fund Administrators (Administradoras de Fondos para el Retiro), as well as those that are applicable by virtue of collective employment contracts or contract-Laws that contain benefits in matters of social security.

The jurisdiction to hear these conflicts, by reason of territory, shall correspond to the Court of the place where the clinic of the Mexican Social Security Institute to which the insured persons or their beneficiaries are assigned is located.

In the event that only benefits related to the return of retirement and housing funds are claimed, jurisdiction shall correspond to the federal Court of the state (federal entity) where the last work center of the beneficiary is located.
