TITLE FIFTEEN. Execution Procedures · CHAPTER I · Section Two. On the attachment procedure

Current text · last reform published in the Official Gazette of the Federation (DOF) on 14 May 2026

When several attachments are levied on the same property, the following rules shall be observed:

I.If they are levied in execution of labor credits, payment shall be made in the successive order of the attachments, except in the case of preference of rights;

II.The attachment levied in execution of a labor credit, even when it is subsequent, is preferential over those levied by authorities other than the Court, provided that said attachment is levied before the auction is finalized.

When the Court has knowledge of the existence of an attachment, it shall make known to the authority that levied it that the attached property is subject to the preferential payment of the labor credit, and shall continue the execution proceedings until payment is made. The net balance remaining after payment is made shall be placed at the disposal of the authority that had levied the attachment.

The questions of preference that arise shall be processed and resolved by the Court hearing the matter, to the exclusion of any other authority; and

III.The party that has levied a subsequent attachment may continue the execution of the judgment or agreement, but once the property has been auctioned, the amount of its credit shall be paid to the first attaching party, except in the case of preference of rights.
